Terms and Conditions of Sale (T&Cs) for Tandem Paragliding Flights
By making a reservation or through any other means, the passenger confirms that they have read, understood, and accepted these T&Cs.
The contract is concluded at the time of the firm booking of the flight by the passenger. In the event that certain provisions of these T&Cs are found to be partially or fully invalid or unenforceable, the validity and effectiveness of the other provisions remain unchanged.
The price of the flight must in all cases have been paid in advance, either in cash or by TWINT.
The pilot is the commander of the tandem glider, and the passenger agrees to follow their instructions.
The passenger confirms that they do not suffer from any health issues (physical or mental) that could affect the safe conduct of a tandem flight with a glider.
The passenger is aware that undertaking a tandem flight with a glider carries risks. For example, under the glider, the pilot’s and passenger’s legs act as the landing gear, which could cause injury in the event of a rough landing or takeoff interruption. Additionally, the risk of sudden and unpredictable wind effects cannot be excluded. Birdway / pilot Jérémy Gremion has subscribed to liability insurance amounting to CHF 5 million for non-commercial flights and CHF 10 million for commercial flights. In the event of bodily or material damage suffered by the passenger during a glider flight, the liability of Birdway / pilot Jérémy Gremion is limited to this amount.
Minors or individuals under guardianship require authorization from the person holding parental authority or a legal representative. When such a person is absent at the time of the flight, a written consent form must be presented to Birdway / pilot Jérémy Gremion beforehand.
The dates scheduled for tandem flights are set in advance, sometimes on short notice. A fixed date may be modified if weather conditions or organizational reasons require it. The final decision regarding the possibility of carrying out the flight lies exclusively with the pilot.
If the passenger cancels the flight when it could have been conducted, the following refund rules apply:

In case of cancellation more than 7 days before the scheduled date, the price of the flight will be refunded in full.

In case of cancellation at least 24 hours before the scheduled time, 50% of the flight price will be refunded.

In case of cancellation 24 hours or less before the scheduled time, the price of the flight will not be refunded.

The passenger confirms that they are insured against the consequences of an accident (even during a glider flight). Accident insurance is not covered by Birdway / pilot Jérémy Gremion. The above-mentioned liability insurance only covers damages if the pilot made an error. If the passenger is injured without the pilot being at fault, the passenger's accident insurance will apply.
The pilot decides if and how mobile phones and cameras may be carried.
In the event of any dispute arising from the tandem flight, passengers from the USA and Canada explicitly waive any jurisdiction in the USA or Canada and acknowledge that neither Birdway nor the pilot will accept jurisdiction in the USA or Canada.
Only the ordinary courts at the Birdway headquarters in Illarsaz are authorized for any disputes arising from the contract concluded for the tandem flight. Swiss law applies exclusively.
